Welcome to Extra Sparkly. By using this website, requesting a quote, reserving rental items, or purchasing services from us, you agree to the following Terms & Conditions. Please read them carefully before booking.
1. GENERAL
Extra Sparkly provides luxury kids party rentals and related event services, including but not limited to children’s tables and chairs, soft play equipment, ball pits, bounce houses, bubble houses, backdrops, décor and event setup services. All rentals and services are subject to availability and these Terms & Conditions.
We reserve the right to revise these Terms & Conditions at any time. Continued use of our website or services constitutes acceptance of any updates.
2. RESERVATIONS AND BOOKING
All bookings are subject to item availability and are not confirmed until approved by Extra Sparkly. A signed rental agreement and payment of a deposit or retainer may be required to secure your event date and rental items. Any quote provided through this website, email, social media, or other communication is an estimate only and may be changed until your booking is formally confirmed.
3. PAYMENT TERMS
A non-refundable retainer or deposit may be required to reserve rental items and services. The remaining balance must be paid in full by the due date stated in your invoice or rental agreement.
Failure to make timely payment may result in cancellation of your reservation and release of your event date and inventory.
Extra Sparkly reserves the right to charge additional fees for last-minute changes, extended rental periods, additional labor, difficult site access, excessive cleaning, damaged items, or missing items.
4. CANCELLATIONS AND RESCHEDULING
Because rental inventory is reserved specifically for your event date, all payments made are non-refundable unless otherwise stated in writing. Requests to reschedule are subject to availability and must be approved by Extra Sparkly. Rescheduling is not guaranteed.
Custom items, personalized items, special orders and third-party purchases made on your behalf are non-refundable.
5. DELIVERY, SETUP AND PICKUP
Delivery, setup, breakdown and pickup may be included or offered for an additional fee, depending on the order and event location.
The client is responsible for ensuring that the setup area is clean, safe, level, dry and accessible at the scheduled delivery and pickup times. If our team is unable to complete delivery or setup due to stairs, long carrying distances, locked gates, pets, poor surface conditions, weather, or unsafe site conditions, additional fees may apply and setup may be delayed, modified, or canceled. An adult age 18 or older must be present at the time of delivery and pickup unless otherwise agreed in writing.
6. RENTAL PERIOD
Rental items remain the sole property of Extra Sparkly at all times. The rental period begins upon delivery or customer pickup and ends when the items are retrieved by Extra Sparkly or returned in approved condition. Rental items may not be moved to another location, subleased, transferred to another party, or altered in any way without prior written consent.
7. CLIENT RESPONSIBILITY FOR RENTAL ITEMS
The client assumes full responsibility for all rental items from the time of delivery until pickup. The client is responsible for any loss, theft, damage, staining, misuse, or destruction of rental items caused by the client, guests, children, venue staff, or any other person during the rental period. If any item is returned damaged, excessively soiled, or missing, the client agrees to pay the cost of repair or full replacement, plus any associated labor, cleaning, shipping, or administrative costs.
8. CHILDREN’S EQUIPMENT AND SUPERVISION
The client is solely responsible for supervising all children and guests using the rental items at all times. Adult supervision is required at all times for all children’s equipment, including but not limited to bounce houses, bubble houses, ball pits, soft play equipment, toddler seating and children’s tables and chairs.
Extra Sparkly does not provide child supervision, attendants, or monitoring unless specifically agreed to in writing.
The client agrees that all rental items will be used in a safe and age appropriate manner. Rough play, climbing on non-climbable items, flipping furniture, pushing, jumping from furniture, overcrowding and misuse of any equipment are strictly prohibited.
9. BOUNCE HOUSES, BUBBLE HOUSES, BALL PITS AND SOFT PLAY SAFETY
For safety reasons, bounce houses, bubble houses, ball pits and soft play equipment must be used only as intended and in accordance with any instructions provided by Extra Sparkly.
The client agrees to ensure the following:
Children are supervised by a responsible adult at all times. • Equipment is used only by age-appropriate children.
Shoes, sharp objects, food, drinks, gum, face paint, slime, silly string, confetti, glitter and pets are kept off and away from the equipment. • No flips, rough play, climbing on walls, hanging from netting, or overcrowding is permitted.
Use of equipment is immediately stopped during unsafe weather or unsafe conditions.
Extra Sparkly reserves the right to refuse setup or require discontinued use of any equipment if unsafe conditions exist.
10. WEATHER POLICY
Certain rentals, especially bounce houses, bubble houses, soft play and outdoor setups, are weather dependent. For safety and equipment protection, Extra Sparkly may delay, modify, refuse, or cancel setup in cases of rain, strong winds, extreme heat, lightning, wet ground, or other hazardous conditions. Weather-related decisions are made at the sole discretion of Extra Sparkly. Any rescheduling, rental credit, or other accommodation, if offered, will be handled in accordance with your rental agreement.
11. CLEANLINESS AND PROHIBITED USE
All items must be returned in the same general condition in which they were delivered, ordinary wear and tear excepted.
Clients must keep rental items free from excessive dirt, mud, food, drinks, cake, candy, gum, glitter, confetti, face paint, markers, crayons, slime, silly string, smoke odors, pet hair and bodily fluids.
Additional cleaning or restoration fees may apply if items are returned excessively dirty or damaged.
12. SETUP AREA AND VENUE REQUIREMENTS
The client is responsible for providing a suitable setup area and obtaining any necessary venue approval, permits, insurance certificates, HOA approval, parking access, or other permissions needed for delivery and use of rental items.
The client is also responsible for confirming that the event location can safely accommodate the size, dimensions and operating requirements of all rented items.
13. ASSUMPTION OF RISK
By renting from Extra Sparkly, the client understands and accepts that party rental equipment involves inherent risks, especially where children are involved. The client voluntarily assumes all risks associated with the use of the rental items and accepts full responsibility for the conduct and safety of all participants and guests.
14. RELEASE AND LIMITATION OF LIABILITY
To the fullest extent permitted by law, Extra Sparkly, its owners, employees, contractors and agents shall not be liable for any injury, illness, death, loss, damage, accident, delay, or other claim arising from or related to the use, misuse, or inability to use rented items, including bounce houses, bubble houses, ball pits, soft play equipment, furniture, or décor.
The client agrees that use of all rental items is at the client’s and participants’ own risk. In all cases, Extra Sparkly’s total liability shall not exceed the amount paid by the client for the specific rental or service giving rise to the claim.
15. INDEMNIFICATION
The client agrees to indemnify, defend and hold harmless Extra Sparkly, its owners, employees, contractors and agents from and against any claims, liabilities, damages, losses, costs and expenses, including attorneys’ fees, arising out of or related to the client’s event, the use or misuse of rental items, guest conduct, child supervision, site conditions, or breach of these Terms & Conditions.
16. PHOTOGRAPHY AND MARKETING USE
Unless otherwise requested in writing before the event, Extra Sparkly may photograph or video its setups, décor and rental items for use in its portfolio, website, advertising and social media, provided no sensitive personal information is intentionally disclosed.
17. WEBSITE CONTENT AND INTELLECTUAL PROPERTY
All website content, including text, graphics, logos, photographs, designs, service descriptions, branding and layout, is the property of Extra Sparkly and may not be copied, reproduced, distributed, modified, or used without prior written permission.
18. FORCE MAJEURE
Extra Sparkly shall not be liable for delays, cancellations, or inability to perform resulting from causes beyond its reasonable control, including but not limited to severe weather, acts of God, venue restrictions, road closures, labor shortages, illness, supply chain issues, government action, or other unforeseen events.
19. GOVERNING LAW
These Terms & Conditions shall be governed by the laws of the State of Minnesota. Any dispute arising out of or relating to these Terms & Conditions or any rental transaction shall be resolved in the appropriate courts located in Hennepin County, Minnesota.
